3. POSTING CONTENT; USER CONDUCT
You acknowledge and agree that all information, data, text, photographs, images, files, drawings, designs, specifications, software, sounds, recordings, graphics, video, messages, tags and other materials, in whatever form and technical structure, whether publicly posted or privately transmitted or stored using the Services (“Content”), are the sole responsibility of the person(s) originating such Content and introducing such Content into the Services. We reserve the right, but shall have no obligation, to pre-screen, reject, review, quarantine, delete or move any Content posted or submitted to the Services, without obligation to any person.
You further agree to NOT:
Use our products or the Services for illegal purposes or for promotion of dangerous activities;
impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with BCR Comply or any other person or entity;
Upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual duties (such as insider trading regulations, internal corporate policies or nondisclosure agreements);
upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
4. Registration and Account Integrity
4.1 As part of the registration process you will need to create an account, including a username & password. It is your responsibility to ensure that the information you provide is accurate, not misleading and relates to you. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party (including ours), or vulgar, obscene or in any other way inappropriate. We reserve the right with or without notice to suspend or terminate any account in breach.
4.2 Where we provide an organisation with a number of user licenses for the Service these must be adhered to. User licenses cannot be shared between users. On our customised plans we will provide an agreed number of licences for each account.
4.3 If for any reason you suspect that your username & password has been disclosed to or obtained by another party you should contact us immediately. Please note that we never contact users requesting them to confirm their username & password or other data.
5. Pricing, Plans and Features
5.1 For current pricing and plans please see the pricing page located on our website or we may provide a customised cost proposal.
5.2 We reserve the right to change pricing, plans and the features offered at any time and without notice to you.
6.Payment and Credit Control
6.1 All services are billed monthly in arrears at an agreed rate or per survey submitted.
6.2 If you upgrade from a free or trial account you will be immediately charged for the necessary full account or accounts. Your monthly payment will be due from that date each month onwards.
6.3 Where the Service has been paid for 12 months in advance, (where this option is offered by us) payment will be taken as agreed with you.
6.4 It is a condition of use that a valid debit or credit card is provided at all times in order for your account or accounts to remain active.
6.5 Where a credit or debit card payment request is made by us and is declined by your card company or bank (for whatever reason) access to your account or accounts may be suspended immediately until such time as a valid payment has been processed and a valid credit or debit card is associated with your account or accounts.
7.1 You have the right at any time to cancel your subscription and any data that we are managing or storing for you remains in your ownership. You may download this data or request copies from us and request that we delete any personal information and/or data that we store on your behalf.
8. Upgrading or Downgrading Accounts
8.1 SAAS users may upgrade or downgrade their plans at any time by sending email to email@example.com. Customers that avail of our customised system will have their payment options reviewed on an annual basis.
9. Trial and Offer Periods
9.1 We may offer prospective users a free trial, this will be agreed on a case by case basis and in agreement with both parties.
10. Technical Support
10.1 BCR Comply provide ongoing technical support on all plans and systems between the hours of 8.00am and 6.00pm Monday to Friday except on public and bank holidays. Additional support plans are agreed on a case by case basis.
11. Content Ownership
11.1 All content, data or information that you upload to our platform remains in your ownership. BCR Comply provide a system for our users to carry out their day to day compliance duties with regard to building construction and building inspection, we provide secure storage for all your content, data and information and we provide customer support to all our clients.
12. Copyrighted Material
12.1 All content, data and information is in your ownership. The platform and all its features are in the ownership of BCR Comply and any features of our system may not at any time be copied or used for any other purpose other that the provision of administration and inspection of construction and buildings.
13. Access and Backups
13.1 You may at any time request a backup copy of all content, data and information that to manage and store on our platform. Data that you may delete, either deliberately or by accident is stored for a limited time on our servers and final deletion will be at your instruction only.
